Supreme Court Overturns Racist Judge Sotomayor
The little hope I have for the Supreme Court in maintaining equal justice under law just went up by about 1 half of 1 percent. Sotomeyor’s opinion that racist hiring to exclude white candidates was called for under federal law was overturned by the Supreme Court.

WASHINGTON -- The Supreme Court ruled Monday that white firefighters in New Haven, Conn., were unfairly denied promotions because of their race, reversing a decision that high court nominee Sonia Sotomayor endorsed as an appeals court judge.
New Haven was wrong to scrap a promotion exam because no African-Americans and only two Hispanic firefighters were likely to be made lieutenants or captains based on the results, the court said Monday in a 5-4 decision. The city said that it had acted to avoid a lawsuit from minorities.
The ruling could alter employment practices nationwide and make it harder to prove discrimination when there is no evidence it was intentional.
"Fear of litigation alone cannot justify an employer's reliance on race to the detriment of individuals who passed the examinations and qualified for promotions," Justice Anthony Kennedy said in his opinion for the court. He was joined by Chief Justice John Roberts and Justices Samuel Alito, Antonin Scalia and Clarence Thomas.
Forget the Term Reverse Discrimination
Racial discrimination is wrong. There is no wiggle room; fancy words such as reverse discrimination, quotas, affirmative action, and others are cover terms for illegal, sinful, and counterproductive racial discrimination.
The Supreme Court’s statement that “Fear of litigation alone cannot justify an employer’s reliance on race to the detriment of individuals who passed the examinations and qualified for promotions” reduces the power of thugs and their intimidation in forcing racial discrimination. This is a small, but very important, step for equal justice under law in America. It will make deliberate racial discrimination in employment harder to justify.
Sotomayor Overturned and Shown to be Racist
By reversing her support for blatant racial discrimination, the Supreme Court is telling us Sotomayor is unqualified and that racist appointments are racist acts. Those who support racist acts have no place in America, certainly not on the Supreme Court. Obama should withdraw her nomination immediately. Failing that, Republicans in the Senate should unite and stand strong. Democrats with a belief in fair play and those who have any distaste or aversion to racism should join with Republicans and send a signal that the Supreme Court is off limits to blatant racists.

But who will overrule Sotomayor when she is on the SC?
Brooke, If all the Republicans voted no they could stop it. Alas, I fear there are too many panty waist RINO's in the Senate. Keeping my fingers crossed.
